Previous reports state that Bruce Jenner's gender transition is not yet complete in that Caitlyn still has male genitals. Having a penis could possibly be a factor to consider for transgenders when jailed.

Westword reports that in Colorado, the state's Department of Corrections and the Denver Sheriff Department house inmates based on their genitalia. Transgender inmates who identify themselves as females but still have a penis are locked up in men's prison and are at a risk of rape.

Caitlyn's reported fear of going to jail, amid the finding of investigators that she was driving too fast in a fatal car accident in February which could lead to manslaughter charges, may have basis. NBC reports that the probers will present the results of their probe to the Los Angeles County District Attorney.

The accident, which involved four vehicles, resulted in death of a woman on the Pacific Coast Highway on February 7. Caitlyn's Cadillac SUV hit a Lexus that hit another car. Kim Howe, the 69-year-old driver of the Lexus, died after collision resulted in the vehicle being pushed into the highway's southbound lane and being hit head-on by a Hummer.

The investigators identified Caitlyn's speed as a factor in the crash which could result in misdemeanor manslaughter charges. But mitigating circumstances could counter the charges.

Alan Jackson, defense lawyer and former prosecutor with the LA Country District Attorney's Office, explains that there is no felony in the case due to lack of the element of gross negligence. He even thinks it should not be a misdemeanor because Caitlyn's conduct was reckless or even ordinary negligence.

Dana Redmond and William Howe, stepchildren of Howe, have filed a lawsuit against Caitlyn. Meanwhile, Detective Richard Curry told Variety that Caitlyn has a 50/50 chance of facing manslaughter charges, reports the Advocate.


If the lawsuit is resolved in favor of the stepchildren and Caitlyn is convicted, hopefully she may not end up like Samantha Hill, a transgender inmate in Florence, Colorado, who still has a male genital. Samantha's cell mate raped her which resulted in a lawsuit resolved by a settlement agreement. However, her main demand for transfer to women's facility was denied.
