Walmart Paid $10 Million Settlement To Comedian James McNair’s Family For Tracy Morgan Bus Accident

Walmart settled a case with the family of comedian James "Jimmy Mack" McNair, who was killed in a June 2014 accident. The family was paid $10 million in the settlement related to the accident that involved Tracy Morgan's tour bus.

The settlement's terms had remained confidential up until now. The agreement was that the retail giant would accept no blame in the high profile case.

A Walmart tractor trailer had collided into Tracy Morgan's tour bus last June, killing McNair and seriously injuring Morgan and Ardie Fuqua. The actors are still recovering from brain trauma that they suffered due to the accident.

E! News had reported in January that a settlement had been reached between Walmart and the 62-year-old comedian, according to E! News. However, at the time the exact amount that McNair's children Jamel and Danita received was unknown.   

The lawyer of Jimmy Mack's family, Daryl Zaslow, made the figure of the settlement public in order to collect his legal fees for the settlement.  He will receive a paycheck of almost $3 million of the $10 million settlement with Walmart.

In a court filing that Zaslow made last month, he stated that the huge settlement was challenging because McNair's income was low when he died. Although many of his colleagues believed his strategy would fail, Zaslow still completed months of tough negotiations with Walmart.

In a public statement Walmart noted that it "cannot discuss" the settlement's terms and conditions. It also stated that its executives "deeply regret" McNair's death during the accident, according to The Interro Bang.

Mack's daughter Danita noted that she was "grateful" for the results of Attorney Zaslow's work. However, she also admitted that no monetary figure could ever replace her father.

Morgan's lawsuit against Walmart filed in July 2014 is still pending.
