KickAss Torrents owner stays in prison as court denies to drop charges

Kickass Torrents owner arrested in Poland on U.S. charges.

Alleged KickAss Torrents owner Artem Vaulin recently filed a motion to dismiss the charge against him but he did not succeed as the court denied to drop the charges.

On July 2016, Artem Vaulin was arrested by Polish law enforcements and was detained in a local prison since then. In October, he filed a motion on behalf of his legal defense team pursuing for the U.S. court to terminate the criminal cases against him, Christian Daily has learned. Kim Dotcom's lawyer is part of Vaulin's defense team.

Artem Vaulin's defense argument was that KAT operated as a search engine that works just like Google, except that Kickass Torrents "indexes BitTorrent files." The defense also claimed that torrent files are naturally not illegal; therefore the operation of a torrent search engine such as KickAss Torrents should not be a crime as well.

Defense counsels Ira Rothken and Theodore Poulos filed a motion on October 17 that stated: "The fundamental flaw in the government's untenable theory of prosecution is that there is no copyright protection for such torrent file instructions and addresses. Therefore, given the lack of direct willful copyright infringement, torrent sites do not violate criminal copyright laws."

Zachary Fardon, the U.S. attorney related Vaulin's motion to that of a drug dealer who needed protection asserting that he had never touched the drug, Headlines & Global News reported. Unfortunatey, the U.S. court declined to agree with the defense motion filed by Vaulin's defense team. It also terminated the motion to dismiss the allegations against him regarding the KAT website.

Although the alleged KickAss Torrents owner Artem Vaulin is still behind bars, KAT alternative torrent sites like The Pirate Bay, 1337X and othesr are still operating. It has been several decades since authorities started the war against piracy, but there is little to no improvement regarding the piracy situation.

They may have sunk several times but they always resurfaced time and time again.
