The Los Angeles district attorney said on Wednesday that there is not enough evidence to charge Caitlyn Jenner with manslaughter or misdemeanor for the February car collision that resulted in the death of a 69-year-old widow.

It also could not be "proven beyond reasonable doubt" that the conduct of Jenner, who was still Bruce when the accident happened, was unreasonable, says court documents, reports People. Jenner's lawyer, Blair Berk, was happy with the DA's decision, saying that despite the accident being devastating and heartbreaking due to the loss of life, it is not necessarily a criminal matter.


The accident, which occurred on the Pacific Coast Highway, killed Kimberly Howe. Her stepchildren filed a lawsuit against Jenner whose dune buggy hit the car driven by Howe after a Prius suddenly stopped. Although Jenner stepped on the car's brake 1.9 to 1.5 seconds before it hit Howe's vehicle, the dune buggy still slammed the Lexus, reports Reuters. Jenner was driving below speed limit and was slightly slower than Howe, according to LA Police.

Before the DA's decision, Jenner has expressed apprehension of going to jail for the death of Howe, especially being sent to a male prison because despite her feminine appearance, the reality star reportedly still has a male genital which is the basis of many correctional facilities in assigning transgender women.

But even if he would have been convicted, Jenner managed last week to officially have her gender and name officially changed to woman and Caitlyn, respectively.
