The nine-year-old Christopher May did not want to go with his mother to the lady's restroom. Instead, he went inside the men's comfort room, while his sister Tori May waited outside.

When Christopher went outside the men's room, he was crying. Tori asked his brother what was wrong. He told his sister that a man followed him inside a bathroom stall. The man locked the door and asked Christopher to "get on the toilet" so he can pee on the child.

Christopher declined, but the man kept on asking. The man eventually gave up.

The suspect was then identified from McDonald's surveillance footage, Chief Jim Napolitano told Chron.

When confronted about the incident, the unnamed man admitted to entering the fastfood restaurant's bathroom, but did not recall having any kind of contact with Christopher, according to Napolitano.

The former U.S. Secret Service agent said that the man was found in his home at Montgomery County and was interviewed on Jan. 20, Tuesday.

The investigators are planning to let the boy identify the suspect from a series of photos. Safe Harbor will be taking the boy's formal statement about the incident.

After due process, Napolitano said that the intel will be passed on to the district attorney's office of the county to be reviewed whether charges will be filed.

McDonald's has been the subject of controversial news in January. A McDonald's outlet in India was closed temporarily after a homeless child was thrown out by a staff member, while another outlet in Japan is under investigation for plastic items found inside their food products.
